Welcome to Up the Hill Inc. By accessing our website or purchasing from us, you agree to the following terms and conditions. Please read them carefully.

1. Overview

These Terms of Service govern your use of our website and the purchase of our products. By placing an order, you agree to these terms.

2. Our Products

All items are made in our shop with care and intention. Due to the handcrafted and botanical nature of our products, slight variations may occur, making each piece uniquely yours. We do not offer returns or exchanges on botanical products—all sales are final.

3. Pricing & Payment

All prices are listed in CAD and may change without notice. Payment is required at checkout through the available methods.

4. Shipping & Delivery

Orders are shipped via Canada Post or courier. We have just added international rates for shipping.  Once a package leaves our shop, shipping is at the discretion of the carrier and beyond our control. We are not responsible for delays, damages, or losses that occur during transit.

5. Rush Orders

We offer a limited number of rush orders, dependant on our staff availability and production schedule. Rush orders may incur a 15%–25% surcharge and additional shipping fees. Availability depends on our production schedule.

6. Intellectual Property

All content on this site—including text, logos, images, and designs—is the property of Up the Hill Inc. and may not be reproduced without permission.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Up the Hill Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of profits, data, use, goodwill, or other intangible losses—arising out of or relating to your access to, use of, or inability to use this website, or from the use, application, or performance of any products purchased through the website.

This limitation of liability applies regardless of the legal theory asserted, whether based on breach of contract, tort (including negligence), strict product liability, breach of warranty, or any other legal theory, even if Up the Hill Inc. has been advised of the possibility of such damages.

8. Governing Law

These terms, your use of the website, and any purchases made from Up the Hill Inc. shall be governed by, construed, and enforced in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law principles.

You expressly agree that any dispute, claim, or legal proceeding arising out of or relating to Up the Hill Inc. shall be brought exclusively in the courts located in the Province of British Columbia, Canada, and you hereby irrevocably consent and submit to the personal jurisdiction of such courts.
